Thursday, 25 February 2016: An owner of a business management firm, Tee Chuan Chai (“the accused”), was found guilty at the Kuala Lumpur Sessions Court for 3 charges of furnishing false information to the Registrar, which are offences under section 12 (1) (d) of the Registration of Businesses Act 1956 (“ROBA 1956”). The false information was submitted to the Registrar through the e-Lodgement services.
The case was heard before Sessions Court Judge Zulqarnain bin Hassan. The Court had heard a total of 2 witnesses after which, the accused pleaded guilty to the 3 charges against him.
During mitigation, the accused through his counsel, Ahmad Zaharil Muhaiyar, appealed for a lenient sentence on the ground that the accused was a first time offender and he did not gain any profit. The Court sentenced the accused to a total fine of RM 15,000 in lieu 2 months imprisonment.
SSM views the offence committed as a serious offence as it affects the credibility and integrity of information kept by SSM. The conviction should be treated as a reminder to the public that prosecution action will be taken if there is an offence committed.

SSM PEROLEHI SABITAN TERHADAP PEMILIK FIRMA PENGURUSAN PERNIAGAAN KERANA MEMBERI MAKLUMAT PALSU MELALUI PERKHIDMATAN E-LODGEMENT SSM
Khamis, 25 Februari 2016: Seorang pemilik firma pengurusan perniagaan, Tee Chuan Chai (“OKS”), telah didapati bersalah melakukan kesalahan di bawah seksyen 12 (1) (d) Akta Pendaftaran Perniagaan 1956 (“APP 1956”) kerana telah memberikan maklumat palsu kepada Pendaftar.
Kes ini telah dibicarakan di hadapan Hakim Mahkamah Sesyen Zulqarnain bin Hassan. Mahkamah telah mendengar 2 orang saksi di mana selepas itu, OKS telah mengaku bersalah terhadap 3 pertuduhan yang dikenakan terhadapnya.
Ketika mitigasi, OKS yang diwakili oleh peguamnya, Ahmad Zaharil Muhaiyar, telah memohon hukuman yang ringan dengan alasan kesalahan ini merupakan kesalahan pertama OKS dan dia tidak mendapat apa-apa manfaat daripada tindakannya.Mahkamah telah menjatuhkan hukuman denda sebanyak RM15,000 jika gagal bayar 2 bulan penjara.
SSM memandang berat kesalahan yang serius ini kerana ia menjejaskan kredibiliti dan integriti maklumat yang disimpan oleh SSM. Oleh itu, sabitan ini merupakan peringatan kepada orang awam bahawa tindakan pendakwaan akan diambil sekiranya berlakunya kesalahan di bawah peruntukan undang-undang yang dikawalselia oleh SSM.
Pendakwaan dijalankan oleh Pegawai-Pegawai Pendakwa SSM bagi pihak Pendakwa Raya iaitu Najia Abdul Razak, Muhammad Afif Abdullah dan Tengku Nor Zurairah Tengku Abdul Aziz.
